Commercial Policy

1.1

Rushline Sports Unipessoal LDA offers products for sale on the website profastpool.com, and its e-commerce services are available exclusively to end users / “Consumers”.

1.2

Throughout these Terms and Conditions, whenever “Profast Pool” is mentioned, it refers to the trade name of Rushline Sports Unipessoal LDA.

1.3

A “Consumer” means an individual acting/purchasing outside their trade, business, or profession. If you are not a “Consumer”, you are requested not to place orders on the profastpool.com online store.

1.4

Profast Pool reserves the right not to process orders received from users who are not “Consumers” or which do not comply with the general sales conditions of Rushline Sports Unipessoal LDA.

1.5

These general terms and conditions of sale exclusively govern the offer, transmission, and acceptance of orders placed on profastpool.com between consumers of the Profast Pool online store and the seller.

1.6

The “Consumer” must provide the “Seller” with a valid and complete email address or other contact details and agrees that the “Seller” may use such details to contact them when deemed necessary.

How to Order

2.1

To place an order on profastpool.com, the user must have an email account and a browser configured to accept cookies and pop-ups in order to enjoy all navigation features of the Profast Pool online store.

Placing an order is simple:

Find the products you wish to purchase;
Add the selected products to the Cart;
Proceed to checkout;
Select the payment option;
Review your order;
Complete the payment and confirm the order;
You will receive an order confirmation by email.

Your order is confirmed when you click the “Confirm Payment” (Checkout) button at the end of the purchase process.

Once Profast Pool receives your order, a message will appear on the screen with your order number and details. The purchase agreement is concluded at that moment.

An order confirmation will be sent to your email. We recommend printing or downloading it for future reference.

We reserve the right not to accept your order or to cancel it even after automatic confirmation.

By submitting the order form, you accept the general terms and conditions of purchase, as well as any other conditions available on profastpool.com, including the general terms of use.

The seller may refuse to process orders that lack sufficient guarantee of payment; that are incomplete or incorrect; or if the ordered products are no longer available. In such cases, you will be informed by email that the sales contract has not been concluded and the reasons why.

If products displayed on profastpool.com are no longer available at the time of your final access or when the seller receives your order, the seller must inform you within 30 days of receipt of the order.

If payment has already been made for unavailable products, the seller will refund the amount paid.

2.2 Right to Refuse or Cancel Orders

Profast Pool reserves the right to refuse any order for any reason. We also reserve the right to cancel any purchase (even if already accepted), including but not limited to the following situations:

The product is no longer available/in stock (payments will be refunded);
Billing information is incorrect or unverifiable;
The order is flagged by our Security Systems as incorrect or potentially fraudulent;
Payment transfer has not been received within 5 days after order acceptance;
If we believe you are under 16 years old;
If we believe you are a reseller;
Delivery to the provided address is not possible.

2.3 Data Verification

After receiving your order, we may carry out certain checks before preparing it.

These checks may include address verification, creditworthiness assessment, and fraud screening. Fraud screening involves partially automated checks on all orders to filter unusual or suspicious transactions.

By confirming your order, you agree to these verification procedures.

Guarantees and Product Pricing

3.1 Payment Methods

Available payment methods are listed in the website footer and on the checkout page. We do not accept any payment methods other than those specified. We are not responsible for any loss or damage resulting from attempts to pay through unauthorized methods.

3.2 Payment Processing

If paying by Credit Card, the amount will be charged when your order leaves our facilities.

All credit card details are transmitted via encrypted protocol to the electronic payment provider, without third-party access.

This information will only be used to process the purchase or refund, or to report fraud to authorities if necessary.

The purchase price and shipping costs will be charged when the products are actually dispatched.

Order Security

4.1

The profastpool.com store uses one of the most robust encryption technologies available.

Payment information is encrypted from entry until processing and is not stored on public servers. However, internet data transmission security cannot be fully guaranteed.

If paying via Multibanco reference, order processing begins only after payment confirmation. If payment is not received within 3 calendar days, Profast Pool reserves the right to cancel the order.

Retention of Title

Profast Pool retains ownership of the products until full payment has been received.

Prices

6.1

Prices displayed include VAT. Shipping fees apply per order and depend on the delivery country.

6.2

All prices are quoted in euros. Changing the delivery country may affect pricing.

6.3

The total price at checkout includes taxes and shipping. Please pay only the amount specified in the order confirmation.

6.4

Prices may change without prior notice. The applicable price is the one displayed at purchase.

6.5

In case of pricing errors, Profast Pool reserves the right to cancel the order.

Quality and Warranty

Profast Pool does not sell defective or substandard products. Product specifications are listed on each product page.

Product appearance may differ slightly due to browser or monitor settings.

Shipping and Delivery

8.1 Delivery

Deliveries are made Monday to Friday, 9am–6pm. Someone must be present at the delivery address. No prior scheduling is provided.

Delivery is considered completed upon signature at the agreed address.

8.2 Delivery Times

Orders confirmed before 12pm on a business day and paid by Credit Card or PayPal are shipped the next business day, with delivery in 24–48 hours (for in-stock items marked accordingly).

Multibanco payments may delay shipment (5–7 days).

Profast Pool is not liable for force majeure events.

8.3 Partial Deliveries

Orders may be delivered in parts if necessary. Customers will be notified by email.

8.4 Inspection Upon Delivery

Customers must inspect packaging upon delivery. Damaged goods must not be accepted.

Claims for non-delivery must be made within 30 days of order date.

Shipping Fees

Shipping fees apply per order and depend on destination country.

Free shipping applies if the order exceeds the minimum threshold defined for the country or campaign.

Returns

10.1 Order Cancellation Before Shipment

Orders may be cancelled before dispatch by contacting info@profastpool.com.

10.2 Defective Products

Customers may return defective products within 14 days of receipt.

10.3 Withdrawal

Customers may return unused products within 14 calendar days if:

Products have not been used;
Original condition and packaging are intact.

Products showing signs of use cannot be returned.

10.4 Gift Returns

Gift recipients cannot directly process returns. The purchaser must initiate the return.

10.5 Exchanges

Follow the Returns procedure for exchanges.

10.6 Return Information

Return shipping costs are borne by the customer.

Refunds are processed using the original payment method.

Promotional Codes

Promotional codes:

Are valid only for online purchases;
Cannot be sold, exchanged, or shared publicly;
Are not cumulative;
Cannot be exchanged for cash;
May be invalidated in case of misuse.

Availability

All orders are subject to availability. Unavailable products will be refunded.

Validity of Promotions

Offers are valid only while displayed. Profast Pool reserves the right to cancel purchases resulting from errors.

Liability

Profast Pool is liable only for damages resulting from contractual breaches or applicable legal obligations.

Liability is limited to:

Damage to Profast Pool products;
Reasonable and demonstrable costs;
Maximum compensation equal to the product price.

No liability applies for misuse of products or third-party damages.

Applicable Law

These Terms and any disputes shall be governed by Portuguese law.

Amendments

Profast Pool may amend these Terms at any time. The applicable version is the one in force at the time of order.

Website Information

Profast Pool is not responsible for inaccuracies unless resulting from intent or gross negligence.

Trademarks and Copyright

All trademarks and content are property of Profast Pool or respective owners.

Reproduction or other use without written authorization is prohibited.
